US AI Laws 2026: Every State Law That Affects Your Business
There is no comprehensive federal AI law in the US. Instead, a patchwork of state laws creates a complex compliance landscape. Here are the ones that matter most for small businesses.
Colorado SB 205 (February 2026)
The most comprehensive state AI law. Requires risk assessments, consumer notifications, and governance policies for high-risk AI systems.
NYC Local Law 144 (Active since 2023)
Bias audits and candidate notification for AI in hiring. Applies to any employer hiring in NYC regardless of company size.
Illinois (January 2026)
AI Video Interview Act requires consent for AI-analysed video interviews. HB 3773 requires notification when AI assists with HR decisions. HB 3021 requires chatbot disclosure.
California CCPA (January 2026)
New automated decision-making technology regulations require pre-use notices, opt-out mechanisms, and detailed AI system information.
Other states to watch
Texas, Virginia, Kentucky, New Jersey, Maine, and Utah all have AI-specific requirements taking effect in 2025-2026.
